What is Estate and Probate Litigation?

Estate and Probate Litigation involves legal disputes related to the Administration of a deceased person’s Estate or Trust. These matters are typically handled in Probate Court and may arise before or after a person’s death.

Common causes of litigation include:

  • Family disagreements over Inheritances
  • Questions regarding the validity of a Will or Trust
  • Concerns about how an Estate or Trust is being managed
  • Allegations of undue influence or financial exploitation

At DM Cantor Estate and Probate Practice (Formerly known as Cantor Law Group) we have encountered many cases that have involved Probate litigation for a myriad of reasons.  The most common reasons are as follows:

  • The Divorced Spouse is making Insurance claims.
  • An outdated Last Will and Testament (LWT), Multiple Wills, or missing papers.
  • Contested Will due to Incapacity or Undue Influence.
  • Unlocated Assets.
  • Executor or Personal Representative Abandonment, or Misdeeds/Mistakes.

Estate and Probate Litigation Matters We Handle

Our Arizona Estate Litigation Practice focuses on protecting Beneficiaries, holding Fiduciaries accountable, preventing Asset Dissipation, and enforcing the Intent of Wills and Trusts.

Will Contests in Arizona

We represent clients in will contests involving:

  • Lack of testamentary capacity
  • Undue influence of family members, caregivers, or third parties
  • Fraud, forgery, or altered documents
  • Improper execution under Arizona law
  • Conflicting or multiple Wills

Will Contests require rigorous factual investigation, expert analysis, and a Firm command of Arizona law.  DM Cantor’s Estate and Probate Practice represents clients seeking to challenge or defend Wills, ensuring that the decedent’s “Testamentary Intent” is enforced, and that improper conduct is exposed.

Arizona Trust Litigation

Trust disputes often involve serious “Breaches of Duty”.  We represent both Beneficiaries and Trustees in cases involving violations of Fiduciary Duties, such as Trustee “self-dealing”, mismanagement of Trust Assets, failure to provide timely Accountings of Trust Assets, and removal and replacement of trustees.

Heir and Beneficiary Disputes

We pursue decisive legal action to clarify rights and enforce lawful Inheritances for Disinherited Heirs, Omitted Beneficiaries, and disagreements over Estate Distributions.

Our approach to Arizona Estate and Probate Litigation is direct and results-driven:

  • Early intervention to preserve assets and evidence

Estate and Probate Litigation FAQs

Can a will be contested in Arizona?

Yes.  Under Arizona law, a will may be contested on grounds such as “lack of testamentary capacity”, undue influence, fraud, forgery, or improper execution. In a high-net-worth estate, will contests often arise when last-minute changes alter long-standing Estate Plans or significantly shift inheritances.

What qualifies as undue influence in an estate dispute?

“Undue influence” occurs when a person exerts improper pressure on a Testator, thereby overcoming their free will and resulting in an Estate Plan that reflects the influencer’s interests, rather than the Decedent’s intent. This kind of influence frequently involves caregivers, spouses, advisors, or individuals with access to the Decedent during periods of vulnerability.

What are a trustee’s fiduciary duties under Arizona law?

Trustees in Arizona owe strict “Fiduciary Duties”, including the duties of Loyalty, Impartiality, Prudence, and Transparency. They must manage trust assets responsibly, avoid conflicts of interest, provide accurate accountings, and act in the “Best Interest of the Beneficiaries.”  Breaches of these duties can result in personal liability and removal.

Can a trustee or personal representative be removed?

Yes. Arizona Courts may remove a Trustee or Personal Representative for breaching fiduciary duty, mismanaging assets, failing to provide required disclosures, conflicts of interest, or incapacity.

Can financial exploitation or power of attorney abuse be challenged?

Yes. Arizona law provides remedies for financial exploitation of vulnerable or elderly individuals, including abuse of Powers of Attorney.  These cases often involve improper transfers of wealth, unauthorized transactions, or manipulation by trusted individuals. Prompt legal action is essential to stop ongoing abuse and recover assets.

Is estate litigation always resolved in court?

Not always.  While many cases are resolved through negotiation or “Mediation”, a successful resolution depends on effective leverage and careful preparation.  We prepare every matter as if it will proceed to Trial, which strengthens our negotiation position and ensures we are fully prepared if litigation becomes necessary.
